Terms of Service

Overview

This website is operated by Tarik Azirar trading as SupplementMe. Throughout the site, the terms "we", "us" and "our" refer to SupplementMe.

SupplementMe provides this website, including its information, content, features, products and services, to enable customers to browse and purchase our products (the "Services"). Our online store is powered by Shopify.

These Terms of Service ("Terms") set out the terms on which you may access our website and purchase products from us.

Please read these Terms carefully before using our Services or placing an order. By accessing our website or purchasing from us, you agree to these Terms together with our Privacy Policy, Refund Policy, Shipping Policy and, where applicable, our Purchase Options Cancellation Policy.

Nothing in these Terms affects your statutory rights as a consumer.

1. Access and Eligibility

You may use our website only for lawful purposes.

You must be at least 18 years old to place an order through our store.

When providing information to us, including your name, email address, billing information, delivery address and payment details, you agree that the information you provide is accurate, current and complete.

If you create a customer account, you are responsible for keeping your account credentials secure and for activity carried out through your account.

We reserve the right to suspend or restrict access to our Services where reasonably necessary, including in cases of suspected fraud, misuse or unlawful activity.

2. Our Products

SupplementMe sells food supplements intended to complement a varied and balanced diet and healthy lifestyle.

We aim to provide accurate descriptions, images, ingredient information and other product information on our website. Product packaging, colours and appearance may occasionally differ slightly from images displayed online.

Packaging and other non-material aspects of a product may also be updated from time to time.

You should always read the product label, ingredients, directions for use, warnings and other information supplied with a product before using it.

Information provided on our website is for general informational purposes and is not intended to replace medical advice, diagnosis or treatment. Where appropriate, you should seek advice from a suitably qualified healthcare professional before using a food supplement, particularly if you are pregnant, breastfeeding, taking medication, under medical supervision or have concerns about whether a product is suitable for you.

Food supplements should not be used as a substitute for a varied and balanced diet and healthy lifestyle.

Nothing in this section limits your statutory rights where a product is faulty, incorrectly described, unsafe or otherwise does not conform to your legal rights.

3. Orders and Contract Formation

When you submit an order through our website, you are making an offer to purchase the products in your order.

After placing an order, you will normally receive an electronic confirmation. We reserve the right to refuse or cancel an order where there is a legitimate reason to do so, including where:

  • a product is unavailable;

  • we are unable to authorise or receive payment;

  • we cannot deliver to the address provided;

  • we reasonably suspect fraud or misuse;

  • an applicable purchase restriction has been exceeded; or

  • there is an obvious error in the price or description of a product.

If we cancel an order after payment has been taken, we will refund the relevant amount using the original payment method.

Please review your order and delivery information carefully before completing checkout.

If you need to request a cancellation, please contact us as soon as possible using the form on our Contact Us page. If your order has already been processed or dispatched, your request will instead be dealt with in accordance with our Refund Policy and your statutory rights.

Products purchased from our consumer store are intended for personal or household use and not for unauthorised commercial resale.

4. Prices and Payment

All prices are displayed in the currency shown on our website.

The price you pay for a product will be the price displayed when you place your order, subject to the correction of obvious pricing errors before an order is accepted.

Prices displayed to UK consumers include any applicable taxes. Any applicable delivery charges or other charges will be clearly shown before you complete your order.

We may change our prices, promotions or discounts at any time, but changes will not affect an order that has already been accepted.

You agree to provide accurate and complete payment information and confirm that you are authorised to use the payment method provided.

Payments are processed securely through Shopify and/or our applicable payment providers. We do not receive or store your complete payment card details ourselves.

5. Shipping and Delivery

Delivery options, estimated delivery times and applicable charges are set out during checkout and in our Shipping Policy.

Delivery estimates are provided in good faith but may occasionally be affected by circumstances outside our reasonable control.

We will deliver your order to the delivery address supplied when you place your order. You are responsible for checking that this information is correct.

Unless otherwise agreed, we will arrange delivery within the period required by applicable UK consumer law.

Products remain at our risk until they come into the physical possession of you, or a person identified by you to receive them, except where applicable law provides otherwise.

If your order is delayed, lost or damaged in transit, please contact us using the form on our Contact Us page so that we can investigate.

6. Cancellations, Returns and Refunds

Returns, refunds and order cancellations are governed by our Refund Policy, which forms part of these Terms.

UK consumers purchasing online may have statutory cancellation rights. Where these rights apply, they exist independently of any additional voluntary return period that we offer.

Certain exceptions apply under consumer law. In particular, where goods are supplied sealed and are not suitable for return due to health protection or hygiene reasons, the statutory cancellation right may be lost if those goods are unsealed after delivery.

This does not affect your rights where an item is faulty, damaged, not as described or otherwise fails to meet the standards required by law.

Please do not send products to an address without first following the return process described in our Refund Policy or contacting us through the Contact Us page.

7. Subscriptions and Other Purchase Options

From time to time, products may be made available through subscriptions, pre-orders or other purchase options.

Where a purchase option is offered, additional terms concerning recurring payments, cancellation and management of that purchase will be displayed before you complete your order.

Our Purchase Options Cancellation Policy applies to these purchases and forms part of these Terms where relevant.

8. Product Availability and Purchase Limits

All products are subject to availability.

We may limit the quantity of a particular product that may be purchased by a customer or household where reasonably necessary, including for stock-management, safety or fraud-prevention purposes.

We may discontinue products or change our product range at any time.

If a product becomes unavailable after you have placed an order and we cannot fulfil the order, we will contact you and refund any payment relating to the unavailable item.

9. Intellectual Property

Unless otherwise stated, the content made available through our website, including our branding, logos, text, graphics, photographs, product imagery, website design and other original content, is owned by or licensed to SupplementMe.

You may access and use our website for your personal, non-commercial use.

You must not copy, reproduce, distribute, modify, publish, commercially exploit or otherwise use our content without our prior permission except where permitted by law.

Third-party trademarks, logos and other intellectual property remain the property of their respective owners.

10. Third-Party Tools and Links

Our website may contain links to third-party websites or provide access to services or features supplied by third parties.

We do not control third-party websites and are not responsible for their content, availability or privacy practices.

Your use of a third-party service may be subject to that provider's own terms and policies.

Nothing in this section excludes responsibility that we cannot lawfully exclude.

11. Relationship with Shopify

SupplementMe is powered by Shopify, which enables us to provide our online store and Services to you.

However, purchases made through our store are made directly between you and SupplementMe. Shopify is not the seller of the SupplementMe products you purchase through our store.

Your dealings relating to orders, products, returns and refunds are therefore with SupplementMe, subject to any separate services that Shopify provides directly to you under its own applicable terms.

12. Privacy

Our collection and use of personal information is governed by our Privacy Policy.

Because our store is hosted by Shopify, Shopify also processes certain personal information in connection with your access to and use of our store.

Some of our service providers may process information outside the United Kingdom. Further information about how your information is collected, processed, shared and protected is provided in our Privacy Policy.

13. Reviews, Feedback and User Content

If you submit a product review, suggestion, comment, photograph or other content to us, you confirm that you have the right to submit that content and that it does not infringe another person's rights or contain unlawful, misleading, defamatory, abusive or malicious material.

Where you submit content for publication, you grant us permission to use, reproduce and display that content in connection with SupplementMe and the promotion of our products and Services.

We may remove or decline to publish content where we reasonably believe it breaches these Terms or applicable law.

You remain responsible for the content you submit.

14. Prohibited Uses

You must not use our website or Services:

  • for any unlawful or fraudulent purpose;

  • to infringe our rights or the rights of another person;

  • to transmit malicious software, viruses or harmful code;

  • to attempt to gain unauthorised access to our website, accounts or systems;

  • to interfere with the security or operation of the Services;

  • to submit deliberately false or misleading information;

  • to impersonate another person;

  • to conduct fraudulent transactions; or

  • in any other way that materially damages, disrupts or abuses our Services.

We may restrict access where we reasonably believe these Terms have been breached.

15. Website Availability and Information

We aim to keep our website available, accurate and secure, but we cannot guarantee that it will always be uninterrupted or free from technical errors.

We may temporarily suspend access for maintenance, security, technical or operational reasons.

We may correct typographical errors, inaccuracies or omissions relating to product information, availability, promotions and other website content.

Nothing in this section permits us to alter an accepted consumer contract in a way prohibited by law.

16. Our Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms excludes or restricts:

  • your statutory rights as a consumer;

  • liability for death or personal injury caused by negligence;

  • liability for fraud or fraudulent misrepresentation;

  • liability arising under applicable product safety or product liability law where it cannot legally be excluded; or

  • any other liability that cannot lawfully be excluded or restricted.

We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill, subject to applicable law.

We are not responsible for losses that were not reasonably foreseeable when the contract was made.

Our products and Services are supplied for private and domestic use. If you use them for an unauthorised commercial or business purpose, we are not responsible for business losses such as loss of profit, revenue, business opportunity or anticipated savings, except where the law provides otherwise.

17. Events Outside Our Reasonable Control

We will not be responsible for a delay or failure caused by circumstances outside our reasonable control.

This may include disruption to postal or courier services, severe weather, natural disasters, widespread technical failures, industrial action, acts of government or other events that we could not reasonably prevent.

Where such an event materially affects an order, we will take reasonable steps to minimise the effect and communicate with you where appropriate.

Your statutory rights remain unaffected.

18. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed only to the extent necessary.

The remaining provisions will continue in effect.

19. No Waiver

If we do not immediately exercise a right or remedy available to us under these Terms, this does not mean that we have waived that right or remedy.

20. Governing Law

These Terms and contracts between you and SupplementMe are governed by the laws of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom, you continue to benefit from any mandatory consumer protections that apply to you and may bring proceedings in the courts available to you under applicable law.

Nothing in these Terms restricts any mandatory rights you have under applicable consumer law.

21. Changes to These Terms

We may update these Terms from time to time, for example to reflect changes to our Services, business practices or applicable law.

The current version will be published on this page.

Changes will apply to future use of our Services and future orders from the date on which the revised Terms take effect. We will not retrospectively change the contractual terms applicable to an order already accepted unless permitted by law or agreed with you.
